These Terms govern your use of map.diamonds (the Site), the jeweller directory, and the Diamond digital artwork (the Diamond). By using the Site, requesting a listing, connecting a wallet, or buying or stealing the Diamond, you agree to these Terms. If you do not agree, do not use the Site or interact with the Diamond.

The smart-contract bytecode that governs on-chain ownership and payments is separate from these Terms. Where the contract and these Terms conflict on ownership, payment split, or takeover price, the contract controls for those on-chain facts. These Terms control the Site, display, listings, and off-chain conduct.

1. What map.diamonds is

map.diamonds has two products:

A machine-readable directory of verified jewellers for AI Agents. Confirmed houses appear in map.json. Empty is valid.
One contestable 1/1 Diamond, an ERC-721 digital artwork on Ethereum (token ID 1), with a placement on the map and an HTTPS destination URL chosen at purchase.

The directory does not sell ranking or display advertising. The Diamond holder may display an approved banner and link. The Site does not use analytics products.

Nothing on the Site is financial, investment, legal, or tax advice. You should take your own advice before paying fees or interacting with the Diamond.

2. The directory

Eligibility

Directory listings are for real jewellers we can verify. We may refuse any request. We may ask for proof of business identity, address, and website control before a house is written into map.json.

Price

The listing fee is $111 USD per year for a 2027 Founding Listing. The remainder of 2026 is included free. The fee is fixed. It is not pay-to-rank, not an auction, and not an advertising buy.

At launch, signup is by email to listings@map.diamonds. Payment and onboarding are arranged manually. Confirmed houses are written into map.json by the operator. Sample and preview data are never live inventory.

Our rights over listings

We may refuse, suspend, blank, or permanently remove a listing at any time, including where the business is unverified, misrepresented, spam, illegal, adult or pornographic, off-standard for the directory, or otherwise harmful to the Site or to AI Agents that rely on it.

Removal or refusal does not create an automatic refund. Refunds, if any, are only as we agree in writing.

Agent use

AI Agents and other users may rely only on confirmed listings in map.json. Missing means unknown. Invented listings, prices, or hours are not authorised by map.diamonds.

3. The Diamond (artwork)

Nature of the work

The Diamond is an experimental digital artwork and collectible. It may or may not be notable.

The Diamond gives no share in map.diamonds or claim on directory revenue. There is no promise of profit or repayment. It is digital artwork with no physical diamond redemption.

How ownership works

One token. One owner at a time. Permanently contestable.
Ownership changes only through the contract’s takeover function (not ordinary transfers or marketplaces, unless the deployed contract expressly allows them).
On each steal, the buyer sets latitude, longitude, and an HTTPS destination URL. Those three are fixed until the next takeover. There is no owner edit after purchase.
The contract allocates 90% of each steal to treasury and 10% to earlier purchase shares. The first purchase goes entirely to treasury. Each purchase adds one permanent share after distribution. The next takeover price is the price paid multiplied by 1.33, rounded down to whole wei.
Holders may claim accrued royalty ETH through the contract and Site tools where available. Claims do not consume shares.
We do not seize or transfer your token by admin action. A pause, if any, freezes takeovers only and does not revoke token ownership.

Canonical ownership and payment facts live on the chain. Site UI is a cache and display layer, not truth.

Security review and administrator controls

No independent contract security review was completed before mainnet launch. Automated tests do not guarantee that the contract is free of defects. A defect, compromised key or unavailable service may cause loss.

The administrator can pause takeovers indefinitely, change the token metadata URI and change the treasury recipient for unwithdrawn treasury funds. Pausing does not stop royalty claims or treasury withdrawals. The administrator cannot seize the token, change the fixed price multiplier or royalty percentage, or withdraw the holder royalty reserve as treasury funds.

The metadata and artwork depend on map.diamonds and its hosting. They may change or become unavailable. The on-chain token does not guarantee permanent access to those files.

Art, display, and the destination link

Owning the Diamond on-chain is separate from what map.diamonds displays.

We may blank, unlink, hide, or refuse to render a destination URL, banner, name, handle, or map placement display when we judge the material non-compliant, illegal, adult or pornographic, infringing, misleading, spam, unsafe, or off-standard for the Site.

If we suppress display, you still hold the NFT unless and until another wallet steals it under the contract. Suppression is not a seizure of the token and not a refund.

Destination and content standards

By setting a destination URL, name, handle, banner, or other materials, you warrant that:

you have all rights needed to submit them;
they are accurate and not misleading;
they do not infringe anyone else’s rights;
the destination is not illegal, and is not porn, adult content, or other material we ban;
the destination is a verified jeweller site we can confirm, or another destination we have approved in writing.

You remain responsible for the content at any URL you set, including after we stop displaying it.

We may require jeweller verification for Diamond destinations the same way we do for directory listings. We may keep a short hand-approved allowlist for exceptions. Either way, our display decision is final.

Optional profile and banner

Display name, X handle, and banner (where the contract and Site support them) are public, fixed with the purchase, and replaced by the next buyer. Handles are unverified. Image bytes for banners may be stored on our servers; the purchase may store an image hash on-chain. We may refuse or remove a banner under the same standards as destinations.

4. No value promise

We make no promise that the Diamond, any listing, any destination, or any royalty share will hold, gain, or recover value. Assets may lose value or become hard to trade. Secondary prices, if any, are set by third parties, not by us.

5. Payments, fees, and irreversibility

Directory fees in USD are due as arranged. They are refundable only if we agree in writing.
Diamond payments and network (gas) fees are paid in ETH on-chain. Once a transaction is confirmed, we cannot reverse it.
Wrong network, wrong wallet, failed interface, mistyped placement, or a steal you regret is your risk.
We are not responsible for third-party wallet, bridge, RPC, or marketplace losses.

6. Blockchain and technical risks

You accept that:

network fees vary and may be high;
smart contracts may contain bugs or behave unexpectedly;
network congestion, forks, or outages may affect the Site or the contract;
private-key control is yours alone;
you are responsible for your own legal and tax compliance in every place that applies to you.

You should consult your own advisors before interacting with the Diamond.

7. Licence to the Site; our IP

We and our licensors own the Site design, text, branding, directory compilation, and related materials. You get a limited, revocable licence to use the Site as offered. You do not get ownership of map.diamonds IP by holding the Diamond or by listing.

Holding the Diamond does not grant copyright in the artwork beyond whatever personal use rights follow from owning the token, unless we grant more in writing. It does not grant a trademark licence in “map.diamonds” or related marks.

8. Acceptable use

You must not:

scrape or overload the Site in a way that harms it;
attempt to break wallets, contracts, or Site security;
submit malware, phishing, or deceptive links;
use the Site for illegal activity;
represent an unverified house as a confirmed listing;
imply that map.diamonds endorses a destination beyond displaying it while compliant.

We may block wallets, emails, or access where we see abuse.

9. Privacy

We process listing emails, artwork submissions and moderation records to operate the Site. Wallet addresses, purchases, placements and royalty activity recorded on Ethereum are public. Do not send private keys or recovery phrases to the Site.

Your browser contacts Vercel for hosting, OpenFreeMap for maps, and PublicNode or dRPC for Ethereum reads. Phone pairing uses WalletConnect. These services receive your IP address and the request information needed to provide their service. WalletConnect telemetry is disabled. Our media service processes IP addresses for rate limits and handles artwork uploads and moderation. We do not request your device location.

Address searches and coordinates selected for address lookup pass through our server to Komoot’s public Photon service, using OpenStreetMap data. Photon receives the search and our server IP address. We cache results for 30 days. Search only for public placement addresses.

Your browser may store wallet sessions, purchase recovery information and cached history locally. Your wallet may use its own service providers. Contact listings@map.diamonds about privacy.

10. Disclaimer

The Site, the directory, and the Diamond interface are provided “as is” and “as available,” without warranties of any kind, to the fullest extent allowed by law. We do not warrant uninterrupted access, error-free contracts, or fitness for a particular purpose.

11. Limitation of liability

To the fullest extent allowed by law, we and our operators, officers, and contractors are not liable for any indirect, incidental, special, consequential, or lost-profit damages, or for loss of ETH, tokens, data, or business, arising from the Site, a listing decision, a steal, a suppressed destination, or contract behaviour.

Our total liability for any claim relating to the Site or these Terms is limited to the greater of (a) the USD listing fees you paid us in the twelve months before the claim, or (b) £100 (or local equivalent), except where liability cannot be limited by law.

Nothing in these Terms excludes liability that applicable law does not allow to be excluded.

12. Indemnity

You will indemnify and hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your listings, destinations, banners, names, handles, content, or breach of these Terms.

13. Changes

We may update these Terms by posting a new version on the Site and changing the “Last updated” date. Continued use after posting means you accept the update.

Smart-contract bytecode already deployed does not change because these Terms change. New deployments, if any, will be disclosed on the Site.

14. Governing law

These Terms are governed by the laws of the Republic of Costa Rica, without regard to conflict-of-law rules. Courts of Costa Rica have exclusive jurisdiction, except where mandatory consumer law gives you other rights.
